Your contract with Golf & Travel France Limited is governed by English law, and any disputes shall be dealt with by the courts of England & Wales.
We operate a Trust Account managed by Travel Trust Association. Our membership number is Q6098. TTA was established in 1993 and is a subsidiary of WorldChoice and is the largest Travel Trust in the UK, with more than 1050 members. The Travel Trust Association is the only travel network in the UK to guarantee 100% financial protection to the consumer.
A Trust Account is the surest way of providing 100% Financial Protection. The basic principle of a Trust Account is that the consumer’s money is held in a secure account which is administered by Trustees and can only be accessed by the member once the consumer has returned from their holiday or the payments to the suppliers completed. In addition to being held in trust, you also have a financial guarantee from the Travel Trust Association where the TTA guarantees the financial obligation of its members up to a maximum of £11,000 per passenger via an insurance put into place when the client pays the holiday deposit. The guarantee certificate for your holiday will be emailed to you on request. The Trust Account plus the guarantee ensures that all the money you pay is safely protected. Our Trust Account meets all the requirements of the 1992 and 2018 Package Travel Regulations and gives total security for your money.
Golf & Travel France Limited trading as Golf Holidays By Morgan has an ATOL Licence, number 12417.
“All the flights and flight-inclusive holidays reserved for our clients are financially protected by the ATOL scheme. When you pay you will be supplied with an ATOL Certificate. Please ask for it and check to ensure that everything you booked (flights, hotels and other services) is listed on it. for more information about financial protection and the ATOL Certificate go to: www.atol.org.uk/ATOLCertificate.
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.
We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable). If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.
For up-to-date travel advice from the UK government, visit www.gov.uk/foreign-travel-advice and https://travelaware.campaign.gov.uk. We recommend that you consult these websites before booking in order to make an informed decision about your chosen destination, and again before departure.
We strongly advise that you purchase suitable travel insurance to cover unforeseen medical, personal and travel situations. It remains your responsibility to read and understand the insurance policy and ensure that it is suitable and adequate for your particular needs. Please read your policy details carefully and take them with you on holiday. If you choose to travel without adequate insurance cover, we will not be liable for any losses suffered by you in respect of which insurance cover would otherwise have been available.
Travel Insurance with Covid-19 Cover – available through Holiday Extras and Rush Insurance
Travel insurance with FCDO advice cover – available through Battleface
In these booking conditions, “Events Beyond Our Control” means a situation which is beyond our or the supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Such situations are likely to include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, flood, epidemics and pandemics, fire, airport, port or airspace closures, restrictions or congestion, flight or entry restrictions imposed by any regulatory authority or other third party, an FCDO advisory against travel to a particular destination and any other government restrictions on travel. Except where otherwise stated in these booking conditions, we have no liability including for compensation, costs and expenses in such situations.
The holiday contract is between the party leader and Golf & Travel France Limited. The contract commences when you have confirmed that you would like to proceed with the holiday and have been considered to have read and understood these Terms and Conditions of booking by agreeing to proceed with the holiday arrangements and paid your deposit (or balance payment if the holiday departure date is within one month). The holiday contract is subject to English Law and is binding under the relevant conventions. You may, however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so. A Confirmation of Booking will be sent to you as soon as you request the arrangements to be made and the key elements of the holiday arrangements have been put in place. This Confirmation of Booking will also detail the payment requirements or any payments already made. This Confirmation may contain some complementary arrangements that have yet to be confirmed i.e. tee-times at a busy or exclusive golf club. We will of course provide a solution if any complementary arrangement is not possible. The Confirmation is published on your own Golf Holidays By Morgan Welcome Page and will show a clear holiday itinerary and payment schedule with the times, places and particulars of the transport, accommodation and other arrangements involved in the holiday. It will also detail the total cost payable unless otherwise stated. Please read it carefully (including the Notes section) to ensure that the itinerary is correct as changes can be more difficult to make if left until later.
We will advise you of the deposit required at time of quote/booking. The deposit might be higher for groups as some suppliers also require a holding deposit. More and more of our hotels are offering Early Payment Deals which are discounted rates in return for paying for your hotel at the time of booking. If appropriate, we will highlight these discounts to you on your holiday quotation. However, the Early Payment Deals are non-refundable and the hotel will not refund your payment if you have to cancel the arrangements. The balance must be paid no later than four weeks before the start of your holiday to enable us to honour our arrangements with our suppliers. If you have any questions regarding the payment of your holiday please call us on 0207 8701258.
The price on your Confirmation of Booking will be the total cost of your holiday as detailed and will include any supplements payable unless otherwise stated. Charges will be made for balance payments made by credit cards (see Payments By Credit Card below). There are no charges for payments for deposit payments made by credit cards or any deposit or balance payments made by debit card, bank transfer or cheque. The holiday prices are based on the commercial exchange rate for the relevant destinations as of the week of your booking as listed by the Financial Times guide to worldwide currencies. These rates are available on request.
Changes to the Consumer Rights Act were made to stop profiteering from “over the top” fees when businesses and consumers choose to pay by bank card. We have never charged more than we are charged by the merchant provider processing the card payment. Sections 9.2-11.2 of the Act states “the government considers the legitimate surcharges could include fees directly charged to the payee such as The Merchant Service Charge, which companies pay to their payment service provider when processing the payment….etc”. We use Trust Payments to process bank card payments and are charged between 2% and 2.6% (depending on the card type i.e. Visa, Mastercard, Amex, and their current transaction charges) when processing credit cards; we pass on about 50% of those charges for balance payments made by credit card, so please expect the appropriate additional charge of about £12.5 for every £1000 paid. We do not charge for payments made by debit card, bank transfer of cheque and we also do not charge for deposit payment made by credit card if the total amount is under £2000.
Please note that we insist all clients (and everyone in the party) take suitable Personal Holiday Insurance – either through your normal insurance broker or a specialist travel insurance company. We will assume, unless you inform us in writing, that you have adequate and suitable insurance cover either through an annual or bespoke cover for the trip arranged by Golf & Travel France Limited trading as Golf Holidays By Morgan. We also advise you to inform the insurer, irrespective of your age, of any pre-existing medical conditions (treated up to two years prior) or all cardio-vascular and any other serious conditions at any time prior to your holiday departure.
Hire car insurance is included in our packages featuring car rental so please read carefully the hire car agreement when collecting your hire car as you may be asked to pay for an insurance already included in your holiday cost. We also include Excess Refund Insurance in our hire car prices so you avoid any nasty surprises and costs. Excess Refund Insurance means that you will be refunded (usually within two weeks) of any Excess you have had to pay to the hire car company in the event of an accident. Our costs for the Excess Refund Insurance are considerably less than buying the cover when collecting the vehicle.
Entry requirements – such as Visa, immunisations and your health – for the destination are your own responsibility. We can advise you on Visa requirements for each destination on request and we strongly suggest that you seek expert medical advice regarding your destination and any pre-existing medical conditions that you, or any of your party, may have. Do not take chances with your health and always choose a holiday destination that has suitable levels of health care.
We ask you to inform us of your party’s playing standard as this assists the planning of your golf. Generally speaking, it is advisable to travel with a copy of your Handicap Certificate although these are not necessary for our clients at most Clubs. However, if it is apparent that your standard of golf or etiquette is not suitable, the golf clubs do reserve the right to ask you to leave the course.
Please advise us if any person in your party has special requirements so that a suitable room can be reserved and buggies can be booked where available. Please note that we cannot guarantee the provision of these special requirements but we do guarantee our endeavour in requesting them. For instance, we cannot be held responsible if the bedroom is no longer available due to a technical fault or if the buggies are no longer allowed due to adverse weather conditions.
Changes in dues, taxes or fees chargeable for services mean that the price of your travel arrangements may change after you have booked. You will not be charged for any increase equivalent to 2% of the price of your holiday cost but we reserve the right to pass on the increase in price above that. If this means that you have to pay an increase of more than 10% of the original price of your holiday arrangements, you will have the option of accepting a change to another holiday if we are able to offer one (of equivalent or higher quality you will not have to pay more. If the alternative is of lower quality you will be refunded the difference in price. You can also choose to cancel and receiving a full refund of all monies paid, except for any amendment charges and non-refundable payments already made to suppliers. Should you decide to cancel for this reason, you must exercise your right to do so within 7 days from the issue date printed on your final invoice.
Should you make an amendment – such as altering the date of your holiday – we will charge you an administration fee of up to a maximum of £100 plus any charges incurred by us. Ferry companies, cross-Channel operators and airlines are increasingly charging amendment and cancellation fees and we will have to charge you for these costs, so please ensure you provide us with your correct travel details dates, times and passenger names. If you are booking your own flights, please pay due attention to their terms and conditions of the airline and any modifications they may send as this may have a direct effect on the rest of your holiday arrangements. Please refer to the above cancellation conditions if your holiday is cancelled due to a government-imposed quarantine or lockdown.
Should you or any of your party cancel of your own volition, the following charges will apply. Please bear in mind the consequences of Early Payment Deals as detailed in the section “Deposit and full payment” above.
Where you are choosing to travel to a destination subject to the FCDO advice against non-essential travel, you accept that once your booking has been confirmed, if you decide not to travel due to the FCDO advice, you will have to pay our standard cancellation charges as shown in these booking conditions – you are not entitled to cancel and receive a full refund in these circumstances, as it is assumed and you confirm that you have made your booking with full knowledge of the FCDO advisory against non-essential travel.
Please note that we will have no liability for any refunds, compensation, costs, expenses or other losses of any kind incurred by you (including, where applicable, the cost of medical treatment), in the following circumstances:
If this happens whilst you are on your holiday, please notify us immediately and we will provide such reasonable assistance as we can in the circumstances. However, we will not be responsible for covering the cost of any curtailment of your holiday, missed transport arrangements, additional accommodation required, or other associated costs incurred by you. Your travel insurance may cover some of these costs for you – please check the policy wording.
We regularly ask all our suppliers if any maintenance or improvement works are taking place during any of our clients’ holidays. Where we become aware of such work, we will endeavour to inform you and, where appropriate, offer to make suitable alternative arrangements. Should there be any changes to your itinerary between the time of your booking and the time of your holiday departure, we will offer suggestions and ask for your preferred plan of action. We will also contact you should there be any changes to your itinerary between your posted confirmation and the sending of your tickets. In the unlikely event that we have to cancel or drastically change your itinerary, you will be entitled to a full refund or we will offer a replacement holiday of at least equal value. Should Force Majeure lead to a drastic change to your holiday, we will do our best to offer a suitable alternative or offer a full refund less any charges incurred by us i.e. financial protection insurances put into place as part of the holiday itinerary agreed by you, and exchange rate losses incurred when suppliers refund us payments made on your behalf . If you are booking your own flights, please pay due attention to their terms and conditions of the airline and any modifications they may send as this may have a direct effect on the rest of your holiday arrangements.
If the contract we have with you is not performed or is improperly performed by us we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. We will also pursue appropriate compensation on your behalf should any of the third-party suppliers not perform in the expected manner. However we will not be liable where any failure in the performance of the contract is due to you or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.
Our liability, except in cases involving death, injury or illness, shall be limited in accordance with and/or in an identical manner to the contractual terms of the suppliers that provide the components of your holiday. These terms are incorporated into this contract; and any relevant international convention, for example the Athens Convention in respect of travel by sea and the Berne Convention in respect of travel by rail, which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions. You can ask for copies of the transport companies’ contractual terms, or the international conventions, by sending a suitable email to [email protected]
If you are booking your own flights, under EU law you have rights in some circumstances to refunds and/or compensation from your airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be published at EU airports and will also be available from airlines. If your airline does not comply with these rules you should complain to the Civil Aviation Authority on 020 7379 7311 or http://www.caa.co.uk However, reimbursement in such cases will not automatically entitle you to a refund of your holiday cost from us. Your right to a refund and/or compensation from us is set out in the clause titled ‘Changes and cancellations by Us’.
The description of the regions, hotels, courses and other aspects of the holidays in our brochure and website are based on opinions gained on personal visits to them and on the opinions of clients, official bodies, guides and professional third parties. We have gone to considerable effort to ensure the accuracy of descriptions and information. We are not always able to exercise control over all the components of the holiday arrangements and it is possible that an advertised amenity be withdrawn or changed due to various reasons such as water conservation, renovation work, etc. We will advise you if we become aware of such a change but we cannot accept liability for loss, damage or inconvenience in such circumstances.
A passport is still necessary for travelling and it is advisable to carry one for identification purposes. Passports, visas and inoculations are your responsibility. Kindly advise our staff if any of your party is not a British citizen or a citizen of another member of the European Union. All passengers including children need their own passport and generally, passports must be valid for at least six months after the date of end of the holiday. Please note that some entry stamps can prevent entry into certain countries and that there may be certain restrictions on one parent travelling with a child. Further information should be sought.
The best advice is: PLAN AHEAD and CHECK YOUR PASSPORT NOW. It is advisable to obtain a copy of the booklet Protect Your Health Abroad and the European Health Insurance Card which offers your UK National Insurance to medical assistance in European countries.
We do our best to ensure your special requests such as restaurant reservations, a particular room number at a hotel or buggies for the golf course, are acknowledged and taken care of by us and our holiday partners. However please note that we can only guarantee you of our endeavour of organising the special request but not the actual provision of the special request…For example, buggies may not be possible because of the weather or mechanical problems. We cannot therefore be held responsible for the lack of provision of special requests and any consequences thereof but we will be happy to provide you with the reasons behind the lack of provision.
Your tickets are created on our own tailor-made ticketing App and published on your Welcome Page approximately two weeks before the start of your holiday. The App displays your vouchers, maps with door-to-door directions, the local weather, the day-by-day itinerary and, if flying, your flight times and Boarding Gate details. The tickets are designed to be shared with everyone in your party so the Group Leader can relax, knowing that everyone has access to the where/when/how of the holiday.
When driving abroad, you should change the beam angle as detailed in your car manual or mask the beam deflector part of your headlights with tape and carry a first aid kit. A set of spare bulbs, warning triangle, nationality indication and insurance documents are obligatory. Speed limits abroad are generally 130 kilometres (110kmh in wet conditions) per hour on autoroutes, 90kph on other major roads, and 50kph in towns. You may be fined or your licence confiscated if you exceed any speed limit. Check all your tyres and tyre pressures, oil levels and coolant systems before going on holiday. Never drive when you are tired – stop and rest or share the driving. Remember to drive on the correct side of the road. We can provide detailed maps with your tickets. You must have your driving licence with you (and other drivers of your car must also have theirs), the registration document of your car (or, if you are not the owner, a letter of permission to take the car abroad) and it is still advisable to obtain a green card from your car insurance company.
All hire cars reserved by us are booked with long-established and higher-end brands such as Hertz, Europcar and Alamo. We do not book hire cars with little-known and local companies as their hidden costs and terms and conditions can lead to very high fees to pay.
Your hire will be fitted with all necessary equipment to adhere to the local requirements. Your licence may be confiscated if you exceed any speed limit. All drivers must present their driving licences and credit cards when collecting the car, all drivers must be aged 21 or over and must have held a valid driving licence for at least two years. The car hire companies are well-signposted and tend to be just outside the main airport terminal – follow the signs for Car Hire. Hand in your car hire voucher at the booth. You will be asked to present your licence, credit card and be given a form to sign – please ensure you do not sign for extra insurance unless you want it. You will then be asked for an imprint of your credit card – this will only be used in case of damage to the vehicle. It is a good idea to check the car for damage before you drive away. Please take a few moments to get used to the controls before you leave the car park and do remember to drive on the correct side of the road! Thieves can sometimes tell if a vehicle is a hire car by the registration – be extra careful and never leave valuables on show. When returning the car, allow an hour for checking it in. Always return the vehicle with a full tank of fuel except if your hire car is booked on a Full to Empty basis.
In general, rooms are available for occupancy between noon and 3pm on your day of arrival and should be vacated by 11am on your day of departure. Your luggage can be left with the hotel reception if need be.
We can advise on and reserve flights on your behalf. Scheduled flights are usually booked with GoldMedal (ATOL 2916) at a lower-than-public cost with particularly interesting prices for Premium Economy, Business and First Class. Low-cost flights are booked direct with the airline at the public cost. All flights are covered by an Airline Failure Insurance policy taken out on your behalf and included in your holiday cost.
You will receive details of our emergency telephone number with your tickets. Should you have any queries or problems please do not hesitate to contact us; we will respond to your query at the earliest possible opportunity. Minor problems with the hotel and golf courses should be brought to the attention of the relevant establishment – it is usually the case that a misunderstanding has led to your dissatisfaction and the issue can be resolved quickly and to your approval.
The Consuls protect the interests of their citizens abroad and can help issue emergency passports, contact relatives, advise on how to transfer funds and make representations on your behalf to the local authorities in certain circumstances. A Consul cannot intervene in court proceedings or pay bills or book accommodation. Foreign alcohol is often stronger than at home and spirits can be served in more generous measures – watch how much you drink. Most of our suggested destinations are credit-card orientated so only a minimum of cash need be carried. Respect the law and avoid any involvement with drugs.
All the establishments offered in our programme have been inspected by us or third parties with whom we have a working relationship. Although we make every effort to ensure that our suppliers comply with national and/or local fire and health and safety laws, please bear in mind that safety standards vary from country to country and may not always be as stringent as in the UK. Liability insurance requirements also vary considerably from country to country, as does the responsibility placed on organisations by law. The monitoring, enforcement and compliance with such regulations and standards is the responsibility of the respective local authorities and the supplier of the services concerned.
Any excursions on your holiday, whether organised by ourselves, our representatives or by yourself, are undertaken at your own risk. You must ensure that you have suitable and adequate insurance before taking part in the excursions and that you exercise reasonable care. Safety standards in some destinations are not as thorough as in the UK and it is your responsibility to ensure that you are satisfied with the health and safety standards of any excursion or activity during your holiday. Please contact us if you require any safety certificates or insurance policies held by any excursions you want to undertake whilst on holiday. The best fun is safe fun and prudent care should be practised at all times when on holiday and/or abroad.
We advise that you take all reasonable precautions to protect yourself and your party while on holiday. For example, you should familiarise yourself with the hotel layout and emergency escape routes of your accommodation, check the depth of a swimming and do not swim until at least an hour after eating. Do not leave children unsupervised in or around the swimming pool area. At beaches, be aware of depths, tides and currents and swim along the shoreline and not out to sea. In your hotel, never climb balcony railings and keep furniture away from the railings. Always accompany children in lifts particularly if the lifts do not have internal doors. Some hotels have beams or alcoved rooms so mind your head as it may take you a little time to get used to them. If you take medication, ensure you have enough to last while you are away – for advice on taking medicines abroad visit http://www.hmrc.gov.uk/index.htm and enter “medicines abroad” in the Search facility.
All times quoted on the Confirmation of Booking are local.
Many of our hotels offer safes in the bedroom – if these are not available, ask the hotel reception to keep your valuables for you.
Always check if service is included before you pay the bill. It is becoming more common that service is included.
Many parts of the world are warmer than the UK so don’t take a chance with sunburn. Use suitable suntan lotion and don’t sunbathe too much, too soon.
Unused vouchers cannot be refunded unless you have alerted the supplier beforehand and they have agreed to refund Golf & Travel France Limited.
We do our very best to ensure that we and our suppliers provide you with what we have reserved. If they do not, we will seek to provide a quality solution except where your actions led to the failure and where unforeseeable circumstances meant that the failure could not have been avoided – even in these instances, we will endeavour to ensure the holiday arrangements are in place from then on. It is your responsibility to inform us and the supplier of any defects or faults at the earliest opportunity. Please do not leave the reporting of these until after the holiday. The earlier you tell us, the earlier we will be able to improve the situation. Should you still be unhappy, please inform us, in writing to [email protected], within 28 days of your return and we will do our very best to provide answers to your queries. Should we not provide reasonable performance of the holiday contract with you, we will endeavour to provide reasonable recompense.
